Rti for provident fund & esi

1. Can I file an RTI to know the amount of PF & ESI that a particular MNC company is paying one of its employees?

2. If yes, where should I file the RTI?

@Queriest,

 

1. Yes,only if the MNC in question,substancially financed or controlled by the government.

2.No,Otherwise

 

If yes,in light of the above criteria,file an RTI to the concerned authority of the company(usually MD).

Dear Sumitra Ji,

The company is a Multi National Company (A Privare Limited Company), its not a government company. There is no stake whatsoever of the Government in this company. 

However, Im assuming there has to be a department in the Government of India where the PF of every eligible employee is deposited, until such time he leaves the company. Can I not file an RTI with this Government Department?

Let me try to put up here few more aspects-

 

1.Now It's clear that you cannot get any information from MNC.

 

2.Despite of PF department coming under RTI purview,the information you seek is exempted from disclosure under clause (e) of section (8) of RTI act(PF department is in fudiciary relationship with that person who you are seeking information of).

 

3.Since that person in context is not employed within the PF department.Hence,not being a public servant.Therefore RTI cannot be used in light of this fact too.

 

Hope you undertand(if not,read few more times with open mind).I am sure,you will be able to understand then.

nformation held in fiduciary capacity can be denied. WEPFO have won case in CIC denying the details of deposits of other persons.

 

you can get the number of persons covered by the company
