Salary not paid

I joined the company three months ago, they hired me for mailing and marketing purpose but gradually I was made to do secretarial work like filing visas, doing owners children home work, photocopy etc. I had 2 yrs exp in marketing field and this attitude and work was not acceptable so I left them suddenly and informed them, as there was no notice period so I did not continue with them, also they have not provided any offer letter which I have asked for.

They are not ready to pay my salry for the month of September and now telling me that I need to clear the issues to go to office and collect my salary. Also they are harassing me that if I don't go to office they will not pay.

Not even this they are blaming me that I have encouraged other staff to leave the job as there is no progress in the company.

 

What can be done in the case.

The employee is not a domestic servant or housemaid.

You could have stated the reasons in notice of resignation/resignation/subsequent communications.

Both salary and salary slips have to be provided.

Submit a written representation to good offices of appointing authority, MD, Chairman.

If the good offices also do not undo the wrongdoings, and do not provide relief then you are left with no choice but to approach lawful authority, court of law……………………..before that you should build favorable written record.

 

>>> You can approach thru Employee’s unions/Trade Unions too even if your designation was Manager…………………like CITU/INTUC/AITUC/BMS……………………….

 

Trade Unions in your state might also be strong.

 Your lawyer may opine that you can approach;

Inspector Under Payment of Wages Act: if your wages were upto Rs.18000/pm as per def. of wages in the Act, within 1year……………….

Inspector Under (name of your state) Shops and Commercial Establishments Act

O/o Labor Commissioner

Civil Courts

 

Complaint u/s406,420……………………..winding up petition…………….

Just serve legal notice to the company or you can also file complaint against the company in labour inspector and after that to labour tribunal.Feel free to call if you have left any query in mind.
