I have invested in a land scheme in 2004. I have made all the payments towards the purchase of the land & also have the receipts from the developer.
As due to some personal problems, the sale deed was not executed & the stamp duty & the registration of the property was not done. Last month, I came to know that the developer had sold the property to some 3rd party. the developer had given an advertisement in the paper asking for the original allotees to come forward & get the property registered.
In this case can we take the property back from the developer? Is it a case of fraud as inspite the full payment being received the property was resold to third party.
