Sale of Flat of a Cooperative Housing Society in KMDA leased

I have a flat in a Cooperative Housing Society built on a land leased out by KMDA. The Cooperative Housing Society in a board of director's meeting has passed the resolution to include the new member in lieu of myself. Is it mandatory for me to obtain a NOC from KMDA to transfer my flat? Can anyone advise if it is a requirement under West Bengal Cooperative Housing Society's Act?

Hi Anirban,

Pleas let me know if you already have any update regarding this transfer.

IF THE HOUSING SOCIETY AS A PERSON (I MEAN LTD) HAS GOT LEASE OF PLOT OF LAND FOR 999 YEARS IN WHICH THE SOCIETY CONSTRUCTED A BUILDING AND IF A MEMBER WANTS TO ASSIGN HIS FLAT( NOT THE LAND) THEN NO NOC WOULD BE REQUIRED. SINCE KMDA IS NOT A PARTY TO THAT ASSIGNMENT.

READ YOUR LEASE AGREEMENT THOROUGHLY. YOU SHOULD NO GO BEYOND WHAT IS SPECIFIED IN THE AGREEMENT.
