Legal notice for 420 and 406

Respected experts

Both husband wife made MOU forbsome xxx amount for settlrment of cases whichb filed by wife in courts after receiving amount now she changed her wotds and deviated MOU. Now husband side wants to file 420, 406 cases against wife for cheating etc.

Now query is that is it mandatory to give legal notice to wife for srttlrment r directly can v file pvt complain in court agaist her.

Pls guide sir

It is not mandatory to issue legal notice but you can directly file criminal complaint in court. against her.

If she has breached the conditions of MOU then he can issue a legal demand notice instructing her to return the amount she took on the basis of the MOU, failing to respond, he can file a suit for recovery of money she had taken in the name of MOU.

If you want to  file criminal complaint or lodge FIR against your wife then do not issue notice to her else Court or police will not entertain your complaint or FIR as matter relates to civil nature.

No need to issue a legal notice for a complaint of alleged cheating and fraud.

No case of cheating and/or fruad is made out from the facts posted by you.

It is better to seek professional services of a local prudent lawyer for proper appreciation of facts/ documents and guidance.
