Property case

 

 

My Father  has sold 92 sq yards  house  to his  Mother  for Rs. 1000/ in the year 1966 and registered in sub registration office. And  Father has expire in the year 1974

 

Family Details

 

  1. Mother had 4 daughters and three sons all are married
  2. Out of 92 sq Yards /   
  3. 60 sq yards  with built up  area 540 sft has  gifted Mother to his third son and registered with sub-registered office of Hyderabad in the year 2004.
  4. Gift deed is valid or not
  5. she expire in the year 2005.

 

 

 

I humble request you sir  that am not aware the law so I needed the answer for the following point.

 

1. Before expire of my mother has gifted 60 sq yards with built up area 540 sft –

    60 sq yards 540 sft has registered at sub-register office hyderabad –is VAILED OR NOT

 

 2. remaning 32 sq yards who is eligible

 

3.  in 32 sq yards of house second brother and two sister are staying

 

Pl give me legal advice in this regard sir

Since it is a registered gift deed, it is deemed to be a valid one. 2, On the remaining portion all the CLASS I legal heirs  are eligible, including the legal heir who got gift deed done in his name, provided nothing has mentioned about his share in(REMAINING PORTION)  the gift deed done by the mother.
