A Pvt Ltd company through his director has filed a criminal complaint against the propreitor and his Power of Attorney (signed person). At the time of Crossing the complainant appeared for the first time and taken permission for the continuation of hearing due to inability. Now again he is taking time for the second time. Reason unknown. Accused says that this is an false case and hence in view of unable to answer properly, he is avoiding. The question here is whether the accused has got any remedy in this case.

File an application u/s 256 of Cr.P.C. and pray for dismiss the case.

For the continuous dilatory tactics adopted by the complainant, the accused has got rights to file a petition or memo  seeking dismissal of the complaint for non-prosecution despite many opportunities given.
