First of all ask him orally to vacate the shop. If he does not comply then give him a legal notice terminating his tenancy telling him to restore the possession of the shop as it is required by you for you own personal need.

As provided in section 16 Maharashtra Land Control Act, landlord can recover possession in case he/she requires the premises back for own bonafide use. If the teenant refuses to vacate the premises eviction suit in small cause court. Bona fide requirement is directly by the following SC judgement 2005 (13) SCC 19.
