Should i file for divorce

Page no : 2

NUT (Programmer)     29 August 2014

Hello ABCD ,

Don't return anything with out proof . Once a Cheetah eats Human beings .. Its becomes a man eater.

similarly Once you budge for your wife tantra (they got the taste), your life is gone in air....

You will become slave to her , she/her family will control you with biased law ..

At this point don't even think about bringing her back home . Keep her aside out of your heart.. basically if you have this soft nature. you will die soon...

Take care of your daughters need, fight for her not for her mother from now on ..

@ABCD WXYZ - If you are the same who started the thread, then I see a lot of hope in resumption of matrimonial life.  When she left you 15 months back, she did not file any case against you.  Only her father was running amok in your relatives bragging about the expenses they had to spend on this problamatic matrimonial relationship.  Your brother-in-law, bad mouthed you in drunken stupor and nothing more can be expected in a hot blooded young man than that.  She had a demand of separate house, which in principle, you accepted.  But see the wonder, in three months, you could not find a one, here I get doubts about your intentions.  To restore matrimonial life, you can certainly find a rented house within three months.  Even then she did not resort to file any case.  But patiently waited making impromptu efforts to make in contact with you by pretending for passport etc.  These are the crude attempts to make the relationship not to die down, but you have taken it in different direction.  Now, I will advise you to the present position:  You said that sent notices for maintenance and DV.  Whether they are lawyer notice or court notice.  Do not bother if they are from anyone of them.  If it is lawyer notice, you give a reply directly to your wife.  Your reply shall be mild (but should not mmention of your slap to her - it is a wrong thing, but you should not admit it in writing, which will have serious repercussions) and pacifying and must be drafted by skilled hand.  If it is court notice, do not over react and next date of hearing appear along with a good advocate, who can pacify the matters and on the first date itself ask for mediation and in mediation take appropriate steps that to meet her legitimate demand of having a rented house and give signals that you will not become violent in future and show your love towards her.  After all, your marriage is a love marriage which indicates that both of you have a loving nature and the time has come to prove it.  Warm regards.

Hi,

I have been married for 18 years. We had a love marriage.  There were several times fight, disputes, arguments, physical abuse, assault.  These all happens only when he drinks. He is a drunkard.  Usually the fight ends when he says he will not to this next time and there will be blame game and finally compromise.

He is a event organiser with NO BUSINESS.  He doesnt give any money to either run home nor for son's education.  I have a son who is studying in 12th std.

Last saturday, we had a big fight.  He banged my head to the wall and lump has formed.

The next day itself i have sent him out of the house as the rental agreement is in my name and i have paid the rental deposit and monthly rent too..

Now i would not want him to come back and disturb me in office/ home (apartment).

1) Can be claim alimony ?

2) I have a built in house (gifted by my parents) too from which i m getting rent, can he ask for a share in property ?

3) when should i file for divorce ?

Regards

Poornima

@chandrashekhar sir Sir, I had back to back 2 deaths in my near family in those 3 months... but I know this should not be any excuse.... also sir she wanted few things from me in written... which i was not agreeing to.. but I just want another chance. .. my advocate is good... my only doubt is what if wife has already written me off her heart... what if she just want to make me suffer... coz she knows m weak emotionally and financially... what if m fighting an already lost battle... I don't care how much she get from as maintence or money in any legal form... I can only give from what I have in my name and I am not scared about that. .. its just the fear of loosing her and my daughter. .. and may be later my mind... It feels like she think everything I say is a lie... what should do??? How should I do??? I know I may sound really stupid... really need any and every guidance.... emotional or legal...
