Sold wrong survey number by seller - denying for correction

 

Hi All,


This is deepak and I am belongs to andhra pradesh.

We are in a critical situation , please help me with your great suggestions.

My Father purchased 6 acers of agri land in 2004 from one of the farmer in our mandal and the farmer told us the 6 acers of land fall into 450 and 374 survey numbers and sold the same to us.


The saledeed executed on the 450 and 374 survey numbers and registered the land on my father name. 


we have got a pattadhar passbook, title deed and had taken loan from andhra bank on 450 and 374 survey numbers but we are in position of 373/374 survey numbers boundaries since 2004.


Later we noticed that 450 survey number doesn't fall into these boundaries which we were intended to purchase and actually the said land fall into 373(4 acers) ,374(2 acers).


And these 3 survey numbers (450,373,374) belongs to same farmer.


Actually we learnt that, at the time of our sale the 373 survey number is not owned by this farmer, the land worngly registered by some third person in 1998 and the person is not in a position. This farmer filed a petetion in the court against the third person and won the case and got the land back on his name in 2006 as per the joint-collector order. 


The third person taken this case to high court and dragged till 2012, In feb 2012 both parties compromised on this case and all legal issues have been cleared on 373 survey number.


When we approched the farmer for the correction of the survey number 450 to 373 in 2012,he is denying for correction of 450 to 373 as per the boundaries on to my father name.  The main reson is this land having high price. Moreover farmer saying that "the land is registered in 2006 on my name, how can I sell the same land in 2004 to you when I am not in posession of that land" and also he insisting us to change the boundaries as per the 450 survey number which were wrongly entered in the saledeed and revenue records.


We are totally lost in this betrayal. Please help us on how to proceed in this situation.

did you obtain pattadar pass books/title deed for the land? obtain copy of adangal of the said survey numbers 450,373,374) of the village
