Spouse transfer

I am Joginder working in  AIIMS patna. I want to apply for transfer to Delhi as my family resided at Delhi. My wife is wrking in PSU (Delhi Metro Rail Corporation). I want to apply for trasfer on spouse ground according to the DOPT’s office memorandum no. -F.NO.28034/9/2009-Estt. (A) Dated: 30/09/2009 of posting of Husband and wife at same station. I ask to Administrative Officer for this. He refused by saying that AIIMS patna is an autonomous bodies and it will not doing transfer. and there is no rule existing. Sir i ned your suggestion what should I do? as I need transfer badly.

 

I am  enclosing my application format as i want to submit kindly suggest me for same.

Respected Sir,

With due respect, this is to inform you that I am Joginder, joined AIIMS, Patna as Pharmacist Gr-II on 13th May 2014. My family residesin Delhi. My parents medical condition needs attention. My father is suffering from rheumatoid arthritis with severejoint pain. He is also suffering with type- II diabetes mellitus. My mother is also suffering with rheumatoid arthritis with severe joint pain and severe back pain due to osteoporosis. Due to their medical condition, they are not even able to walk properly. My wife is taking care of them alone in Delhi.

It is also brought to your kind notice that my wife lives in Delhi with my parents. She is working as account assistant in Delhi Metro Rail Corporation (DMRC), Delhi. Because of family responsibilities and day to day work burden and continuous work pressure at working place, she often gets unwell. It is getting very difficult for my family to live healthy and peaceful life without me.There is no DMRC branch in Bihar. Due to meand my wife residing at different places, we are not able to pursue our normal married life. With regard to posting of husband and wife at the same station, please find enclosed herewith DOPT’s office memorandum no. -F.NO.28034/9/2009-Estt. (A) Dated: 30/09/2009.

My posting in Delhi will be very helpful for my family as I can provide physical& mental support to them.

Sir, under these circumstances, I am in acute need of applying for transfer in certain govt. organisations in or around Delhi. Hence, it is requested that I may please be issued “No Objection Certificate” to apply for transfer and requesting you for your kind recommendation for my transfer in or around Delhi.

You may apply for a similar or suitable post in AIIMS in New Delhi. If you get it, your seniority will be protected

This rule applies to those Ministries and Deptt, which have subordinate or sister concerns or better their own office in other cities where spouse is working like Public Sector Banks, Govt offices etc. obviously DMRC has no office in Patna or AIIMS Patna has no branch in Delhi.

If AIIMS Patna is independent body and not connected with AIIMS Delhi then they cannot be forced by this DOPT circular to open office in Delhi for you. You appear to have no case.

I am not able to agree to the view that your seniority will be protected if you join AIIMS Delhi , if selected. Seniority is not protected if one is transfered to another cadre even if under same employer.
