Stamp duty on Property purchase

I had purchased a flat in 1990. I had paid to the Builder Rs. 18000 for it. Now when I wanted sell it, I needed Index 2 and it was not applicable in 1990. I was now informed that the Builder did not pay the Stamp duty but paid Registration fees only.
Now I am now informed t inhat I have to pay Rs 82000 including interest and penalty where's the Stamp duty was only one percent on value upto Rs 250000 and 4 percent above 250000 amounting to Rs 7500 approximate.
1.Now can we do the following:
How was the Property registered without Stamp Duty?
2. Can we sue the Builder for non payment of Stamp Duty?

I have original receipt paying the Stamp paper fees to the Builder and registering receipt from from Registrar's office. Now I have documents received from Collector claiming belated due payment of Stamp duty/registerstion Rs 158860 and fine of Rs 634400. Will the above documents suffice? Thanks

It is not clear in which City/Town you are located.

In any case, Pl. meet a local lawyer, who is well versed in property matters, show the documents in your possession, explain the facts in person, and then take action as may be advised to you.
