Stay on interim maintenance

Sir,

Wife deserted willfully, with kids and valuables. Thereafter she filed Petition for maintenance from his home. Counter reply has been filed giving the facts. Advocate says interim maintenance will be granted by court without caring for the facts ? Is it so...? If so...can stay on payment of interim maintenance can be obtained from higher court ?

Please advice.
