Suggestion required

Hi ,

I joined a small IT company on 2 weeks back ,and yesterday i resigned from the company.Till now no joining formalities ,background verification ,exchange of docuements is done .Just on a mail before joining the company i accept the offer letter.

I have not even taken a single peeny from company and i worked for two weeks almost free.

No i dont want to go and join the company,can it lead to any legal issue from company side.??Please suggest

and in this case whether der is no formality done from there side regarding the joining ,do i should pay the money for not serving the notice period??

As if private companies work so promptly, they are also like govt offices where everything is tortoise paced.  Had you worked for another 2 weeks you would have got salary also.  These checks etc nobody does, they simply sit and do it after 3 years.  However as there is already a mail, you should have sent a mail regarding your leaving.

Before leaving i Placed a mail to Manager and HR,and I also said that there is a point over there in offer letter that if i dont need to serve notice period ,i have to pay the basic salary of 3 months,and i am ready to pay that .

So can you please suggest will it lead to any legal issue ??

And if they take the penalty i should also take the 2 weeks salary ,can i ask for that ??

You are entitled to your salary even if you have worked for a single day.

 

On the other hand, the employer is also entitled to recover any notice pay which you have failed to pay.

 

Both sides have the right and opportunity to take legal actions against each other.
