Suit for recovery money and damages

Dear Friends,

Can you please help me to find out under which section Suit for recovery of Money and damage claim, suppose to file. I know it is sure of Civil court in Mumbai and Valuation of Damage is more than 1 lac.

Kindly englighted which section should i write on petition?

Brief - Suit for recovery of Money paid as loan.

Movable provperty (Car) was given which was used badly and now Plantif want damages for Car used.

I am trying to find relevet law and sectin to file.

YOU CAN FILE A CIVIL SUIT UNDER ORDER 37(1) A SUMMARY SUIT FOR RECOVER OF MONEY AND DAMAGES WHICH WILL BE EXPEDITIOUSLY DISPOSED OF.iF YOU APPRECIATE THIS ANSWER PLESE GIVE ME ALL MY PROFILE LIKES.

Well you dont need to mention the section. You may just generally file a recovery suit for so and so amount. If it is based upon a contract or a negotiable instrument then you may file it under order 37 cpc. In case you have further queries you may post it here.
