Summon 138 ni act

i got summon in 138 ni act from court.i didnt reply to the notice becouse i want to settle it in court .my  idea is that i shld appear in court and take appropriate time to pay back as it was suggested by your expert views too.

my point is that i got summon from court of mumbai and i am living in delhi.and its of very short period notice.i got this 2 days back and date to appear in court is 21 july.

can i skip my first date as i didnt know anyt lawyer in mumbai and i need time for all thsi??

you should not skip the date but present yourself in the court even in the absence of any engaged advocate and file an application praying for time for defence

Dear JHony

this is a bailableoffence and if you are not going topresent before the court, the court issue a bailable warrant against you afyter that you can arrest by the police and it will be the descrition of the police to release you on bail in police station or take to you in custody and present before the court, so as per my opinion you should appear before the court, if you are unable to go to the court then you can appoint a lawyer over phone and he will be appear before the court on behalf of you and take another date for your personal appearance.
