A gazetted officer who was on Half Pay Leave from 04-11-2019 to 22-11-2019. He relieved of duties on 04-11-2019 by giving relieving RTC (Report of transfer of charge). Meanwhile inorder to escape a complication from Court of law Govt. suspended him from service on 13-11-2019 while he was undergoing leave. Now accountant general (A&E) is asking for joining RTC on 12-11-2019. Is it legal to give a joining RTC the day before suspension when the incumbent actually were on leave? When a joining RTC is given one has to sign attendence register. How can this be done? Is it legal to suspend a person who is on leave? |
Not directly we can't say it is legal or illegal
There may be big loophole,during joining/leave/re joining process....may be communication gap plays vital role to misinterpreat
