Please advise !
A farming land was sold by my grand father's brother in 15000/- to somebody. While making the sale deed the party paid 9700/- and promised to pay the balance in 2-3 days and took the possessation of land and starterd enjoying benefits of the same. But they didn't pay a single penny even after so many oral reminders and written reminders. Then after we canceled the deed and tried to get the possession of the land at this the party filed a Title suit on us in may 1987.
Due to various differences in their statements & witnesses court passed the judgement by dismissing the Title suit in august 1998. We paid the amount of 9700/- with 6% annual interest as directed by Court order.
But all in vain as the party files another appeal in 1998 only, that too got dismissed on 2011 as niether that party nor any lawyer from their side attended the court for further proceddings of the appeal. I have got the judgement papers as well from court on 5th september 2011.
But again when we tried to take possession of the said land their labour insisted and after seeking help from police they released the land after an amount of 6000 as farming labour (as he had already started the process of farming). After 10-15 days It cam to my knowledge that party has again come into the picture and has accuire the land forcefully by threatening my labours. They are also saying that the case is not over yet and they will be filling another appeal on medical terms (By informing the court that they were not able to attend the court for proceedings due to medical problems and thus further dalays).
My question is till wat time they can file an appeal?
What about the benefits of the farm land that they have been enjoying since december 1985?
Since the case was first dismissed in 1998 and we have already paid all the amount taken from them with interest as ordered by court is there any way that we can claim all earnings of that land that they have accquired.?
They are thretening our labours so is there any process to file another suit from our end?
