Issue him a legal notice to vacate the house first] and stop receiving the rent. Then file suit for eviction.

Even if after serving the legal notice, the tenant is not vacating the premises thenYou may also file a complaint to the police for criminal trespassing.

Your agreement with tenant should strictly follow the terms and conditions therein. Either of the parties should issue one month notice to vacate the premises. However, the tenant may demand of 3 monthes time which is negotiable. But after that period, if tenant does not vacate the house or premises, issue him a legal notice to vacate the house first and stop receiving the rent. Then file suit for eviction. Even if after serving the legal notice, the tenant is not vacating the premises then, you may also file a complaint to the police for criminal trespassing.
