Tenant refuses to move or pay hiked rent

Hi All,

I am faced with a very difficult situation because 20 years back a person moved into the 2nd floor of the house and started a office . My uncle who was alive at that point of time let him stay and we had an agrrement then . Then my Uncle passed away and there has been no increase in the Rent since then as my Dad wasnt in the country . Now i am here and when i went to speak to the tenant he is refusing to leave or refusing to pay rent . Please so advice how to go about this as we stay in a prime locality and he still pays the rent which was set 20 yrs back and is a measely sum . Will i be able to make another rental agreement ?? If i can then what if he refuses to sign it ?? Also what is the best procedure to send him a eviction notice ?? . If there is any lawyer close to Cunningham road please do let me know .

It is better to give notice to the tenent.

Pl find enclosed a Hon'ble SC Judgement / Guidelines to minimise landlord-tenants litigations on the same issue. I am also one of the victim like u, (I am not a lawyer, But had 25 years of litigation) Pl go through the Judgment and do take advice from ur local lawyer, and Ask his advice that how to take advantage of this judgment to get reasonable justice... Do convey me his advice for mutual benefit.
