Everyone tries to get a better job than present. So, he also did this. But the problem occured here is , the present organisation where he is working, has a rule that no one can apply for any outside job with in two years of joining. If he had mentioned the current job details, the present organisation would not have issued NOC during interview, which is already over and the result is published.

From the prespectyive of service rules of next employer also it is misconduct, due to concealment of facts.
