To stop sell and partition

 

Dear Sir/Madam,

i,would like to you valuable suggestion and legal advice on that, my parents staying since birth  to continue at B T Road, Kolkata in ONE Katha (total is 2 Katha plot).

That, the property was belonging to in the name my father's grandmother (father’s Dadi) and till day we are paying all taxes in that name.

That, my father’s grandmother had five kids two son and three daughters among two sons one is my father’s father ie”my grandfather.

That, my father has two brothers and seven sisters including himself

That, my grandfather mutually divide property among them (only between Two brother) i.e.” 1 Katha each.

That, we are staying in One Katha Mutually Divided/Partition of Two katha and another one katha occupied by Grandfather’s brother sisters

That, my 2uncle (Chacha) and 7anti (Bua) not staying with us since last 25 years and they all are married and staying utterpradesh with  their family, and only my family me and two brothers staying with my parents in this one katha plot,

That, Now my Uncles come with power of attorney of my 7 Anti (Bua) to sell the property to third party (preplan to our existing shop tenant) without informing my parents and our self.

That, we make an objection to do such thing but they told us” we are selling our part of property (Hissa) in this house “we can sell to anybody without informing you.

That, we told them how you can sell this property without dividing these all property (2 Katha) among all legal heir among of my father ‘Grand Mother” son daughter and their legal heir. They can claim any point of time and ask their place (Hissa) then what we do as you all will are not staying here so such kind of problems we will face in future.

Now we would like to know how this property can be my own by legally procedure by law. What need to do to stop sell this property in such current situation legally? On Urgent basis

dear querist ,

you can urgently take injunction orders under order 39 rule 1,2 c.p.c. and after thaking the injunction oirder you can file declaratory suit for the title of th eproperty as you are inposeession of the suit property and you are paying all the taxex etc.there are many supreme court judgements on similar cases lik eyou ,feel free to contact on mobile number for more detailed advise if you need or any doubt left.
