Total consolidate remuneration treating as basic wages for EPF afflicability-No basic wages pay for the NACO(National AIDS Control Organization)Contractual employees :

Respected Sir/Madam,


Kindly guide us on applicability of EPF to all employees.  


We have been working as Contractual Employees on Contract Basis in ICTC/ART/STI/Blood Banks at General Hospitals, District Head Quarter Hospitals, Area Hospital, Community Health Centers and Primary Health Centers, in the all over Andhra Pradesh on the contract basis more than 15 years on the basis of negligible / less honorarium 13000/-only, more than 1200 employees are working under AP  SACS level and more than 25000 employees working national level. Funding Support by Ministry of Health & Family Welfare, Government of India, through National AIDS Control Organization (NACO), to State AIDS Control Societies (SACS).Union governments is implementing National wide AIDS control plan throughout the nation. AIDS affected Villages / Talukas / Districts from various states have been selected under the centrally sponsored scheme.


Since 15 years Govt. of India has excluded employees working under NACO from applicability of EPF act. From 2002, there is no basic pay fixation and statutory benefits, but have only consolidate pay of sum of Rs.5000.00 per month with annual hike enhancement in a phase wise manner. from 2013 pay wages Rs.8000.00 to Rs.12000.00 but no split in salary, in 2014 as per NACO order A.11011/23/2013/-DAC (HR) Dated: 09.01.2014 in section D Level 5 consolidated pay revised as sum of Rs.13000.00 for month and annual rise of Rs.1250/- was awarded with seniority/ service experience with a maximum pay (up to 3 annual increments) is Rs.16750.00 (Rs.13000.00 + Rs.1250.00 x3= Rs.16750.00) From 1 st April 2015, NACO employees are considered under EPF coverage. But under present scenario of no basic pay, split of salary mentioned for the NACO contract employees. How to fixation as basic wages all salary? The contribution of employee has been deducted from January 2017.But the employee giving their services from 2002 to 2015 onwards, are deprived from the benefit, only benefitted 350 hundred employees only.  More than 90% employees will lose benefit of EPF act if the basic pay is including total salary Rs.20250/-Basic wages  13000/- + with  3 (1250+1250+1250+1250+1250+1000= Rs.20250/-)  annual raise based on experience.

this exemption granted form the 1 april 2005,

this is not applicablae those employee who's join the service before 1 april 2005
