Trainee or apprentice agreement

Hi,


I am HR from one software company , we are recruting 20+ people for their last semester project training for 6 month, after 6 month all guys will join our company.


I need to prepare agreement which tied this people for atleast 1 year after 6 month training to work in our organization, can you please send any sample agreement for this...

All trainee or apprentice needs to learn we are not giving them official work, we only teach them so we can get benefit from them after training.


My questions:

1) I need agreement can any one provide sample here?

2) Can I force them to work for minimum 1year because we are investing 6 month in them?

3) Can I add clause in agreement that, if they want to leave the comapny than 3 month notice period and in addition they need to pay 45,000/- which we spend behind training?

4) this question is regarding Employee not trainee:  Can I add this clause in agreement for employee that , if any employee want to leave the job than they need to give 3 month notice peiod and in addition they need to give us 75,000/- which we spend in staffing,recruting,project planning & knowledge transfer?

 

Please reply me asap with your knowledge ..

1)Hire a Decent lawyer specialing in contracts...Online can provide you suggestions and not the contract itself....

 

 

2) This is governed by the Indian Contract Act...You need to make an offer via an offer letter which is when signed becomes an agreement....Make sure you dont put clauses which might have an effect of 'Undue Influence'(Dominance).....
