This is a right of employer.
Employee in case of exigencies, and health issues as pointed out in your post can make representation/appeal to the reporting authority,appointing authority,MD with reasons, e.g. the lady needs to be looked after.
You can appeal with the relevant medical records, in writing.Employer has to look at the justifications e.g. disease from which the employee is seffering,and also vacancy.
Even if you approach a court, you need to justify to the court.

you can file a application first in your concerned department,can go to tribunial in case of need if it fit case to file or you can also file in district court concerned, can file a case by way of a writ in High Court concerned on valid grounds a writ of mandamus
