our family executed sale agreement and received advance amount while there was a case pending and status quo order prevailing.. the purchaser was aware of the order. he has also mentioned the case number in the sale agreement but did not mention about the status quo order.
now after two long years when we asked the purchaser to pay the remaining amount and register the sale, purchaser refused and instead lodged a police complaint and a case of injunction against us in the court based on the agreement.
we are now in dilemma whether to pursue the case along with the previous case. Kindly enlighten. we are ready to return their amount but do not wish to sell our property to them cos of the harrasment from them.
Why did you execute agreement to sale of property when already case was pending in court and moreover court had restrained you and passed order to maintain status quo? You can't take advantages of your own wrongs and blame on purchased that he was aware of all the facts. Contact to Prudent lawyer for further action.
