FIR with 498a/306 is there. dont know whats the reason for no arrest..its dark hole

Thats why i asked option for AB petition at our local place/city/state?

Yes where much possible to apply AB. unless it is UP/ Uttranchal.

 

Apply for it asap.

find exact details if the case is the court than no arrest possible in other cases bail will be there and as suggested put counter cases.

We are in process of bail not sure how long would it take. regarding case in court, i dont think there is because we have not yet got any summon from court to appear.

Now for counter cases, is this can be done only through filing a counter FIR or we can file counter case against them in court directly?

if this is through FIR than untill and unless we get the bail. we cannot go to police station to File an FIR.

pls suggest.

you can't do much till you get bail.

Update:  Bail is rejected in lower court. Now applying in HC. I have a question here. Is there any role of IO/police directly or indirectly when we apply for AB?

How the court process works after applying AB? Does it take longer ?

Did the deceased have any  ancestral claim and whether her sister is getting benefitted by her death.

The I/O and Prosecution would normally oppose bail.

 

However, there are no set parameters on which the bail would be granted. 

 

Hope your counsel would argue effectively so that you are admitted on AB.

Whether paretns of the deceased were pauper or pavement dwellers? if not then there is a property on which the deceased (if alive) could lay claim and by his death the siblings get better share. Please try to see the logic in what Mr CM Shroff has advised.
