Urgent legal opinion required

 

One of my clients applied for a job for the post of a CA in an organisation for example 1st January, the day on which he was not qualified to apply for the job as the results were not due at that time. However, at the time of the interview viz. 1st February, he passed his CA and was now eligibile for the job.

 

My question is that: will this application made be legally tenable and as is he legally qualified to take the job. also will the application made on 1st January be regarded as legal and not void?

All things depends upon the terms and conditions set for the applicability of the job in question. A job is an offer and all the terms and conditions should be put forth, the acceptance of which gives rise to the process of entering into an agreement.

Therefore,all things should be taken as per Indian Cotract Act 1872.

 

Hope that clarfies the issue.
