Using atm card of another person without his permission

i have a question , suppose i use my younger brother ATM card while my brother is hospitalize and he is in serious conditions. Using his ATM card in these condition is legal ?

U may use, but with consent and in good faith without wrong intentions and misappropriation of funds

You have not disclosed as to how much money was withdrawn and what was done with such money and whether you have given an account of the money withdrawn by you.

Is it a crime or not depends upon the above facts. Please divulge the information and while doing so, you yourself will know as to what you had done is a crime or not.

If he tells his ATM pin number with good intention and withdrawl information to him. It will be good.

All the acts done in the good faith towards the holder of the property are exempted from any crime to be precise, here the mens-rea is the important issue to be found in the action that for which purpose you have utilised his ATM card.
