I have completed my contract JOB is a consulting firm of Gujarat in March 2011, joined in March 2010 at Jamshedpur Project for a MNC Automobile ancillary company. After successfully completing the client work. I was said to release with a option of transfer to another project in Gujarat. I refused for transfer and accepted to release. Then company is deducting amount from my salary as per summary details sent by them. Even I got second increase in my salary from March 2011. I got the salary also without salary notification mail as provided earlier after all salary, For April salary they are creating dispute. Now they are not responding my mails & phone calls.
As per contract job of Project Management & consultancy was for 6 month from March 2010 to August 2010, Company got 2 extensions of 3-3 month, I was verbally said to continue and received two salary hikes also for brilliant output. I received my salary on time without any delay with TDS deduction. I have not received any TDS certificate till date.
A application letter was also send by me to company for fast
settlement, copy of letter has been cut & pasted below for your
reference.
Please advice me for my harassment free settlement recoveries if any
legal action

April 2011
Dear sir,
With reference to pending salary of April 2011 and dues. The
settlement summary detail provided by company & Increment letter by
you, the figure mentioned and deduction shown is un-justified as per
condition with your commitment and assurance in Salary hike with extra
task other then job-profile. After Project contract with client is
over and hand-over on 30th April, I feel company is not in honest
attitude with me and trying to deduct the amount from my salary and
creating dispute in Salary of March & April 2011. Hence there was no
dispute earlier for March salary till 30th April.
The following points which is creating dispute.
Salary of March (arrear) : I received my salary in April with
increment as assured by you. But I did not receive any salary
confirmation, summary details or pay slip at time. While salary
transfer no such comment was followed for medical expense refund & LTA
is included in salary. The assurance given by you was of increased
salary. After job is over in April I am informed that March salary is
includes with LTA + pending Medical refund + arrear for March of Rs.
4000.00 deposited in May 2011. I am getting the increment letter after
job is over only with nominal increase, not matching with salary of
march and several defaults found in maintaining and submitting proper
accounts.
Leave Deduction : Account officer have mentioned deduction of 17
working days from April. There is no absent (Ramnavami Flag Rally,
Adityapur bridge close ½ day) in April and one day absent in March.
All previous absent/leaves/Medical leaves details were furnished to
you by e mail and before my leaves I have intimated by e-mail to you &
client.
Partiality in Salary structure: Partiality such as Salary & Benefits
difference with other site member and work load provided by head
office.
I am entitled for
Increment affected Salary of April.
Arrear of increment for Feb salary.
Medical Expanse refund.
My tenure Over-time pending amount.
Pro-Rata Benefits.
Project Completing Bonus. (If any)
Ex-Garcia for extra task other then job-profile (last two months)
Other benefits as on govt. rules.
As per contract was for 5 months from March 2010 to August 2010,
Company got 2-3 extensions, I was verbally said to continue without
any extension letter and received one salary hike also for additional
work load. I always received my salary on time without any delay with
TDS deduction. (except last two months)
Just on the Last working day 30th April I was said to submit all the
Company liabilities to company representative, I did so with
transmittal letter, from 2nd April onwards I don't have any company
liabilities or dues. (I was having Rs.375.00 only from company
account; this amount was given back on Month Feb 2011.)
Now Company is not acting in honest way and responding in evasive
manner to escape, in settlement summary they are deducting the amount
for Unpunctuality at Site in Previous 11 days + Medical leaves 11 days
+ absent of 24 days of 2010. (In real total absent is of 08 days in
2010 as per Client gate entry).
Once again I will request you to pay my dues and benefits settlement
at earliest, without any harassment and delay.
