Family Court and High Court can't waive the cooling period of six months in the matter of mutual consent divorce petition.Only Supreme court can waive the cooling period of six months.

Conciliation period of six months cannot be waived to get MCD only Supreme Court has got the power to grant relaxation in such cases by invoking the doctrine of irretrievable breakdown of marriage.

Supreme court can waive cooling period of six months. Refer Nikhil Kumar vs Rupali Kumar on 27 April, 2016 case.
