WANT AN OPINION OF EXPERTS

Our Mother owned agriculture lands in Karnataka , the Khatha stood in her name. She demised during the year 2009. We being the legal heirs applied for Khatha transfer now.
It is now come to our knowledge that some portion of our lands is used for formation of site for siteless people by Zilla Panchayath. When investigated in details , it is on record that our lands are not at all acquired by any body, instead our neighbour lands is accquired legally for the above purpose and by mistake officials have transformed layout in our lands and issued Hakku Patra to about 40 members. About 15 members have already constructed houses in our lands. This mistake has been brought to the notice of government.

Now our querry is , The khatha transfer is not happened in our name as Tahsildar has made an order stating that few houses have come up as reported by the surveyor. Now, do we need to file an appeal before the Assistant Commissioner challenging the Tahsildar order or bring it to the knowledge of High Court whereby we have requested for Compulsory accquisation of our land as per the latest land acquisition act. Kindly experts give us an opinion, we are in a fix. We have made everyone party on our High Court Case including Revenue secretary, DC, AC, Tahsildar, Sub registrar and CEO of Zilla Panchayat.

File civil case in civil court against all of them .

Sir , I have already filed a Writ, my query was about to appeal to AC in regards to Tahsildar order for not transferring Khatha to legal heirs.

Writ is not suit ,you have to file declaratory suit in civil court that court will direct them to effect khata to your names.
