Want to get back my plot

Dear Experts

 

A false 498a and DV case is pending for maintenance amount.

I have already applied for chargesheet quash u/s 482 and DV is on evidence stage.

 

Before 2 years i purchased flat worth Rs 5 lac in her name (Registered at 40000/-) her mother and me was witness on deed. She has almost no source of income.I have already given all her gole and mine too worth RS 10 lac (no proof with me)

1) Can i legally asker her to transfer plot in my name again. ?

2) Will it be a help in my DV case to minimise amount of maintenance ?

3) Or on the contrary if she claims that she has purchased out of his own income, then will it help in the sense that she can earn at her own ? (presently she is insurance agent since last 5 years with some commission income)

 

Please advice how should i proceed?

Maintenance different and your said property different.

Once you have given the flat to her, then no point in asking it back, and she cannot claim maintenance as the flat is already in her name.  All attempts to claim maintenance will be futile.

You may, but it wont be of any use.

Yes




3) Or on the contrary if she claims that she has purchased out of his own income, then will it help in the sense that she can earn at her own ? (presently she is insurance agent since last 5 years with some commission income)


Payments made to buy flat, all that evidence you should have to prove that you have paid to buy that flat which you registered in her name, if no proof with you, she can claim anything.

 

Please advice how should i proceed?
