if  any  worker  is  out  of  ESI  coverage  because of  wage  limit , is  it  compulsory  to  company  to  take  Workmen   compensation policy under  Workmen  compensation Act.

There is no compulsion on the company to obtain WC policy but when there is an accident out of or during the course of employment resulting in partial or permanent disablement to the employee the employer is responsible for the compensation. This compensation some times may be huge because of the number of people effected hence it may be very difficult and huge financial implication to the company (Ex: union carbide) hence it is better to cover all the employees under workmen compensation policy hence the concernned inusrance company takes the responsibility of paying the compensation amount.
