What is 156-3 ?

A complaint was lodged in Police but no action taken so filed in court.

Charges U/S 211, 385, 467, 468, 469, 471, 474, 504, 506(II), 34 IPC.

 

Court passed order under 156 (3).

 

What is 156 (3) and what action will be taken / further proceedure??

156(3) of Cr.P.C. :  Magistrate has empowered under sec 190 may order for investigation..

When case is referred to the police officer to investigate, such police officer has to file his report to the court after making investigation.  If he founds there is no sufficient grounds, he shall not investigate the case, if it is investigated and founds there is no grounds then he will file B report to the court.

Such filed report can be challenged by the complainant in the criminal case by filing his objections and leading his evidence..
