Tenant had filed appeal in District and session court of decree passed by small cause court and Distrct court has allowed the appeal throughout cost. What does it mean 'through out cost'. Whether all prayer of tenant allowed.

Why appeal? What is the original case? still requires clarity.

small cause court had given judgment to vacate the shop within month by tenant and tenant appealed in District court and his appeal allows throughout cost.

The appellate court has allowed cost of litigation in favour of appellant.

Consult your lawyer if it is not a time pass query.

The land lord's action for eviction stands dismissed. Moreover, the tenant is to provided by the landlord as to the expenditure (as allowed) towards the cost in trial as well as appellate court.

Yes, tenant's suit for eviction dismissed by appellate court also passed order that landlord shall bear all expenditures incurred to contest the case from trial court to appellate court.

Hi,

It means that the court has also allowed the party in whose favour the order was passed, recovery of cost of litigation.

Best regards,
Megha
