What is best option

Dear Sir/Madam

 

I had filed a divorce case on cruelty basis and by this time my evidence is over and now its other party's turn.No chances of cohabition. if other party is ready for out of court settlement and we both agree to convert this case to MCD.then what option is best for me.

should I contest the case or go for MCD? Considering that I would have been won the contested case.

in which type financial burden is more?

NOTE:- I am not in hurry as I know contested cases goes for years.no child born out.

if you want to get rid soon then opt the mcd and stop all the possiblities of future litigations .

If at this stage the opposite party is opting for mutual settlement and divorce thereon, ask the opposite party to file a memo before the court on the next date of hearing that the opposite party submits to the decree prayed for by the petitioner and not contesting the case anymore.  This will solve the issue instead of withdrawing the existing case and filing a fresh MCD.  Talk to the opposite party and draw out a solution this way.
