What' the limitation period for inherent jurisdiction??

If a party wants to make a plea of  "set aside of  "dismissal order"  and "restore the said application" to the stage prior to the dismissal order (and a condonation plea "to condone the delay in filing this plea") " ....  u/s 151 of CPC ............

 

..... then how to calculate the limitation period (does limitation period become applicable in the first place??)

 

 

Main suit is till pending the trial...

 

 

This 'dismissal order' is in regards to an interim application ... O9 is also not applicable to circumstances ........... and 'dismissal Order' is also not 'appealable' one.

 

 

Please advise

THE PETITION UNDER ORDER 9 RULE 9 CAN BE FILED IF THE ORIGINAL SUIT IS PENDING .  IF IT IS FOR RESTORATION OF AN INTERIM APPLICATION THE SECTION 5 WILL BE APPLIED.  THERE WILL NOT ANY 151 REQUIRED.
