What would be the best option?

Dear All,

Your  learned opinion are solicitated on the question of applicability of provisions being Section 26 of Hindu Marriage Act vis a vis section 7 of Guardian and Wards Act, 1890 in a pending adjudication of Divorce Proceedings.  Either both these sections can run concurrently or which one is best suited and what are the differences if any.  Last but not least whether the principles of equity can be invoked in agitating the question of custody of minor child.  The latest case law in this regards shall be highly appreciated.

Thanks and best regards

What are the other cases filled by the parties?

If any other HMA case is pending then go for HMA 26 otherwise GWA act.
