shrikant v. sathe (retired)     10 December 2012

Who will win?

We, some 25 officers lodge a complaint against one multi state-co-op bank in which we were in service. This bank  had retired us at the age of 55 instead of 58.Although the standing order states that each and every employee at the age of 55, bank does not retire the officer cadre staff at the age of 55 because it had made resolutioin in 1979 that the officers age of retiremnt will be 58.In 2003 it abruptly changed the decision and reduce the retirement age of officers as 55. As we 26 officers are on the officers post before 2003.hence our contention is that we are not governed by the resolution of 2003 which reduces the age of officers as 55.From 1979 to 2003 no officer was retired at the age of 55 but retired at the age of 58.The award staff was retiring at the age of 55+1 year extentsion for 3 times. Now we have lodged a writ petition making a party to the bank and co-op dept. in pune taking into consideration govt. of maharashtra and constitution of India. Now my question is who will win this case?
