Wife denying to live together since 4 yrs

Hi All,

Wife is denying to come and live together with my parents and me and after 4 yrs contacting and threating that i left her and cheated her and she is gonna file divorce due to this.

They have also filed a false dowry case which was investigated andthen dissolved when found it was a false complaint.

My doubts are :-

1. Can a wife force to live in a seperate house from my parents where-in she never havee lived or been in the same house even a single day since marriage(she's in her Mother's house).

2. What is she files a cheating case again (False case as filed before) Not sure, Becasue I keep requesting to come and live together.

3.  We have a girl Child, Will she or Can she claim alimony when she is earning more than me everymonth.

4. I've waited for nearly Five years now, What are the chances of me geeting a MCD if I File it from my end.

5. What is the duration now a days for a MCD to be granted if both the parties havent lived together after the first few days or weeks and no communication for 4 yrs.

Please advise as it 'll bea big help in order to come over this issue am facing .

Seeking a divorce in India is a long-drawn out legal affair, where the period of prosecution takes a minimum of six months. However, the time and money required to obtain a divorce can be considerably shortened if the couple seeks divorce by mutual consent. In this case, estranged spouses can mutually agree to a settlement and file for a “no-fault divorce” under Section 13B of the Hindu Marriage Act 1955. All marriages which have been solemnized before or after the Marriage Laws (Amendment) Act 1976, are entitled to make use of the provision of divorce by mutual consent. However, for filing for a divorce on this ground, it is necessary for the husband and wife to have lived separately for at least a year.

As i mentioned We're living seperately nearly five yrs., She has never lived with me together in my house. Added to that they registered it under Christian marriage Act.

Pleae advise on this grounds.
