Compromising with lot of money is a business of corrupted lawyers and judges. Please stop this. If you compromise then you will remain guild. They can file again 127 CrPC for further maintenance. Please don't go for any "shortcut" way in this case. Please look for a good unmarried girl and start live-in relationship.

If charge sheet is filed then you can not file discharge petition. Getting quashing is very rarest of rare situation if it is not compromise ground. To know more about quashing please see my link bellow.

The best way is go for speedy trial first.

I agree with Rocky Smith regarding not to compromise with the 498a woman.

However, i disagree with starting a live in relationship. Remember, we also thought that our wife was good person and thats why we married her. Now, even the DV law is applicable to Live in relationship as well.

Dont go for compromise......I did big mistake with compromise and am facing problems in Divorce and 498A now .am the  best example ...

I just wanted one clarification, when you say, "don't compromise". What do you actually mean?

 

Don't compromise by giving money or Don't compromise but run the full trial.

Mr. Kapoor,

 

I mean both. Make speedy trial and face full trial and get out of it. Then you have lot of options. But if some body who is accused and compromises then he will remain guilt in the eyes of the law.

 

For example after settlement also she can ask maintenance.

I agree with the view of Mr Rocky Smith that speedy trial is right of every accused but unfortunately (thanks to slithering system) very few get this right.  For entering into this right they have to face another litigation at High court.

 

Let the author have his own views. The forum has given views on both the options

You may have seen SC views on Speedy Trial in newspapers today. It is a right granted to everyone, so can not give preferencial rights to some.

 

Not everyone gets speedy trial remedy.

 

But, I would add. It can not be both. Either you settle or you don';t settle even for ZERO. Which would be your advise.

Speedy Trial is right of all accused but lower courts does not follow. As Mr. Sudhir Kumar is thankful to "slithering system".

 

That is the reason I always advise to apply Speedy Trial in-person (Without Advocate) on top priority. Rest of the clues are applicable after that.

ZERO is not a quantity. Hope you also understand the concept of ZERO.
