wrong charges

My father has been wrongly charged for a theft by my brother's wife and her family and complaint in this regard was lodged at Noida PS, as a pressure tactic by my brother's wife and her family who are quite influential and connected. It seems application has been lodged currently and no FIR at the moment, but it is quite likely. Kindly explain how should we counter this false claim. My father is a senior citizen, and my younger brother's wife and her family are eying on our property and using all types of false allegation tactics on my brother and father. Can Police arrest my father solely on basis on this false complaint. Can we go for anticipatory bail. Jurisdiction is Noida area.

Still only complaint has been lodged and whether your father reside in same house or not.

Need not to file anticipatory bail yet,

no they reside in different address. Is it legally possible to get copy of the complaint lodged. Do we need to counter the charges pressed now, so that this false allegation is not used by my brothers'wife and her inlaws later-on.

sir,

when the wrong charges are made agasint your father and your father name is present in FIR then you must go for anticipatary bail before Sessions Court and if you think all worng charges then you approach Hon'ble High Court for Quashing the charges u/s 482 of Cr.P.C.
