Aggrement of sale validation in ap

A made an Aggrement of Sale in 1977 for a plot amount fully paid. I died in 1990 intestate.

Can we legal heirs sell this plot by validating the aggrement of sale In state of AP? (In AP there is provision of validating a document by paying fine.

As on today this plot is encroched by relatives.

Q. Can we sell this property if so how? Please guide.

The sale agreement period is maximum of three years, but in case it has been recited that the entire sale consideration amount has been received and no specification about the registration, you may try your luck for  registration but who will do it and who will get executed because the buyer is no more now? Ofcourse legal heirs of buyers can receive it but who will sell or execute the sale deed?

Thank you Sir. If we are able to validate the agreement then we can keep the plot?

In the agreement sale for Rs. 100 and Rs. 100 is paid as advance and part payment of the sale consideration. Vendor fails to register he pays 100 + 50. If Vendee fails the he receives 50.

If we are successfull then how to evict the person who is present on the plot and nothing to do with the agreement. He is our relative not in talking terms.

You can request the legal heirs of the seller ,if they  available now,to file suit for recovery of property and criminal case under IPC for criminal trespass, as you have no grounds to proceed against the trespasser
