Mr.Ven had two sons Mr.Aba and Mr.Han and his property was partioned into two parts A and B through Court Settlement on 26-11-88.
On 19-6-1989 Mr.Aba sold the Land to 1)Mr.Gov 2) Mr.Chin 3)Mr.Sri 4) Mr.Vet.He also executes GPA to above 1,2,3, 4 and other transfer document for the said property.
On 08-06-1990 1)Mr.Nag, 2)Mr.Dsa 3)Mr.Gov, 4) Ms.Padma Purchased this Land from Mr.Abba represented by their respective GPA holders.
From 1990 to till date Mr.Nag has built a house at first floor and he is running his industry at the Ground floor premises.He has paid upto date taxes.He has also availed a bank Loan for running the Industry.
From 1990 to till date Mr.Dsa has built industrial shed and rented the Ground floor premises.He has paid upto date taxes.He has also availed a bank Loan.
Mr.Gov has built Five floored industrial shed in 2005 and has to rent his premises.He has paid upto date taxes.He has also availed a bank Loan.
Ms.Padma has sold the property to Mr.Jos in 2001 and Mr.Jose has built industrial shed and running his own industry.He has paid upto date taxes.He has also availed a bank Loan.
Now on Sep 2010 Mr.Aba's second son Mr.X has filed a suit for a share in Mr.Ven property on his father as well as his elder Brother Mr.Y. His claim is that Mr.Aba is an Innocent man and under the influence of his brother Mr.Han has sold all the properties at throw away price and Mr.Aba was always reluctant towards discharging duties towards his family. He also felt alienated and has also requested his due share from Mr.Aba and Mr.Y who initially agreed for some monetary compensation and later backed of as they were unable to compensate him.
Mr.X was a minor(ie two yrs) when Mr.Aba sold land to 1)Mr.Nag, 2)Mr.Dsa 3)Mr.Gov, 4) Ms.padma 5) Mr.Jose in the Year 1990-91. Now he is 23 year and he has filed a suit that property sold by Mr.Aba to 1,2,3,4,5 is not Legally binding.
In 2009 Mrs.Shanta maternal Aunt of Mr.X has filed a suit for partion against Mr.Aba and Mr.Han.
Mr.X insists for Separate possession of suit schedule properties and granting 1/3rd share.
Now how do 1)1)Mr.Nag, 2)Mr.Dsa 3)Mr.Gov, 4) Ms.padma 5) Mr.Jose solve this issue.
