IF THE ABOVE ANCESTRAL PROPERTY GIVEN TO YOU BY YOUR FATHER IS THE ONLY PROPERTY THAT YOU PEOPLE POSSESS, FILE A SUIT FOR THE PARTITION OF PROPERTY AND YOU THREE WILL GET EQUAL SHARES

What are the documents required to file a suite and how many years will take to close the case.

title deed or any other document which shows that the property belongs to your ancestor is needed and a site plan.   it takes nearly two year ,  rest  time defends on court and counsels   and also mode of practice and procedure adopted in your state etc.

in my view you should file case for cancellation of document (if registered one) executed in favour of your sister while claiming partition and possession (if you are not in possession).

my father has two sons and six daughter he has got hundred acres of land -private wakf land for maintenance of family and 18 acres of open land.                                                                                                                                                   father has  given away hundred acres of land to elder son, and he is not giving the income to other members of the family.                                                                                                                                                                                      out of 18 acres father has given six acres to youngest son and balance to be distributed as per islamic law.                                      my question is under muslim law during life time he has done this is it correct ?
