Apartment condominium - not maintained

Dear Respected Members,

I have bought resale flat in the apartment condominium (Pune, Maharashtra) in Dec2020. Society formation is in process and matter is in the high court. Committee members are not maintaining the amenities, facilities (e.g. Gym). If it still apartment condominium, whom should I complain about apartment not getting maintained. Does apartment and society both comes under 'District Deputy Registrar.

If there's no society formed yet then there's no point in complaining against a non existent person or body 

Who are the committee members, whether they come under registered association?

Thanks for the reply Sir. Committee members follows society norms, conduct AGM, appointed CA for audit, makes rules and forces new members to follow. Now I have question, does apartment condominium comes under any association? Whom should I complain?

you cannot lodge any complaint on anybody unless a registeredbody is formed.Just for day to day necessary needs some good people are maintaining.You should note that they are also owners like you and they are not your servants.If you are particular to develop join hands with them and do service to the inmates(apartment).

Thank you so much for the reply. But the old members are doing DADAGIRI. As they don't use gym, they are not maintaining. Old members acquired common area in front of their allotted car parking and not allowing me to use the common area as pathway to go to my car parking. Old members installed flower stands outside their balcony under which I have my car parking entrance, but they don't allow me put shed to my car parking. Old member tenant hit my two Wheeler parked in the common area and damaged my vehicle, but tenant not ready to repair and even committee also supports old member tenant. How I can get justice?

if the tenant or any other member has damaged your property/car whether intentionally or unintentionally, you can claim compensation from them and if they are reluctant then you can lodge a criminal complaint against them with the police for damaging the private property under PPD act.
