Bombay shops & establishment act.

Hi Members, I just want to know about power of 'Shops & Establishment Inspector'. Now in Mumbai many establishments are violating the provisions of Bombay Shops & Establishment Act' by ask workman to work 9 hrs. and more also no fixation of luncheon hrs. Also some of the establishment not have 'Gumasta Licence'. Can shops & establishment inspector take suo moto action on such establishments? If he has not taken any action after complaining about the establishment who violating the provisions of 'Act', what action will initiate on this kind of inspector? Please guide me because I have gone through the above said thing.

The work hours are:

 48 hours/week.

8hrs/day

 

Beyond this OT should be paid.

Upto 48 hours employer may pay single wages and beyond 48 hrs double wages should be paid.

 

After 5 hours rest of 1 hour should be given.

 

Max work hours 9/day, 48 hrs/week. Above it max excess hours allowed /week are 6.

2(19) (28), 14, 48,49, 55, 63, 67(2) (l)

 

Can shops & establishment inspector take suo moto action on such establishments?

 

Yes.

 

“If he has not taken any action after complaining about the establishment who violating the provisions of 'Act', what action will initiate on this kind of inspector?

 

Approach Chief Inspector.

 

Duties of Inspectors are well explained at website of Maharashtra state govt./Dept of Labor website.

 

Trade Unions in Maharshatra are quite active. They can come forward.
