Car parking allowed to owner if flat is leased

Wanted to quickly check if Owner of Flat who is member of society can be denied open parking right in society compound if he lives outside and has has rented his flat and the sub-tenant do not have any vehicle. Also if any Resolution can be passed against allowing any flat owner to park vehicle if they have leased the flat even thought the sub-tenant donot have Vehicle. If resolution is passed then does it become applicable immediately before filing the resolution with Registrar of Societies. Regards

Open car parking may be used either owner of flat or his tenant. If tenant does not possess any vehicle and does not want to use car parking space in that situation owner of flat can use the same and.society can not restrain owner to use the same.

I agree with the views of learned advocate Mr. Goyal in this regard.  If you are restricted from using the parking space entitled to you as a flat owner, you may first issue a legal notice to the association president in this regard and if it is not been  responded properly and the problem seems to persist, you may approach the registrar of societies for relief and remedy.
