Cease & Desist Notice against Infringement of Intellectual Property Rights

I have received above notice from lawyer of another company

i have given contract to website developer to create website and suggested brand name

he has copied all data from another website as it is which irrelevant 

i have tolde him that is not my requirement and not given any approval to make website live however he done

now received notice from another company that trademark copied

Admittedly, you are wrong side of law. Accept the situation and make amends.

thank you for reply

 

i have not described issue fully here

but the company which sent this notice to me asking 20 lakhs as damage which is not due to my fault but all due to website designer

You may reply to the Notice offering your explanation.

The contents of the Notice does not constitute pleading against nor does the amount demnded does not amount to claim against you.

If you are served with a legal notice then it becomes your duty to issue a reply notice denying the allegations.

In your case, the web designer has done this task on your instructions only hence you can be held liable for infringement offence therefore you issue a reply notice and cease and desist thenceforth without pursuing the matter any further.
